Under Section 41 of TACT 2000, police officers have the power to arrest persons suspected of terrorism-related offences without a warrant. These arrest powers also allow the extended detention of persons beyond the maximum 4 days available under standard arrest powers, to a maximum of 14 days.
Further detention of a suspect up to a maximum of 72 hours can only be authorised by a magistrate. What about terrorism cases, Anyone arrested under section 41 Terrorism Act 2000 is subject to a special regime for pre-charge detention under Schedule 8.
What Does Detained Incommunicado Mean
Incommunicado detention is generally understood as a situation of detention in which an individual is denied access to family members, an attorney, or an independent physician. In some cases, as in Spain, incommunicado detainees do not even have the right to notify anyone about their arrest.
